Alabama Real Estate Consumers Agency & Disclosure
Effective May 15, 2026
Under Alabama law (the Real Estate Consumers Agency and Disclosure Act, Ala. Code §§ 34-27-80 through 34-27-88, and Alabama Real Estate Commission ("AREC") Rule 790-X-3), real estate licensees in Alabama are required to disclose, in writing, the type of brokerage service being provided to a consumer. This disclosure must be made as soon as reasonably possible and prior to the consumer disclosing any information that the consumer would want to be kept confidential.
The recognized brokerage relationships under Alabama law are:
- Single Agent. Represents only one party (buyer, seller, landlord, or tenant) in a transaction.
- Sub-Agent. Represents the same party as the listing broker and owes that party fiduciary duties.
- Limited Consensual Dual Agent. Represents both parties in the same transaction, but only with the prior written consent of both parties.
- Transaction Broker. Assists one or more parties in a transaction without representing the interests of any party in a fiduciary capacity. Unless TPRE has entered into a written agreement to act otherwise, TPRE in Alabama acts as a Transaction Broker by default.
TPRE will provide you with the AREC-approved Real Estate Brokerage Services Disclosure form ("Form RECAD") at the first reasonable opportunity. Your signature on that form acknowledges receipt only; it is not a contract for representation.
The AREC publishes Form RECAD and consumer guidance at https://arec.alabama.gov/. This page is informational only and does not substitute for the signed form.
