Required Disclosure (P.L. 2021, c.408)
New Jersey Buyer Service Policy
Effective May 15, 2026
Pursuant to New Jersey's Real Estate Consumer Protection Enhancement Act (P.L. 2021, c.408; N.J.S.A. 45:15-17.4 and N.J.A.C. 11:5-6.1 et seq.), TPRE is required to publish its standard policy regarding showings of real property to prospective buyers. Our current policy is as follows:
- Mortgage pre-qualification or proof of funds. Prospective buyers are generally requested to provide a mortgage pre-qualification letter from a lender, or written proof of funds, before being shown property. This requirement may be waived for initial consultations or open-house attendance and may be adjusted on a case-by-case basis at the discretion of the listing agent or brokerage.
- Identification. Prospective buyers are generally requested to present a valid government-issued photo identification before being granted access to a property. This is for the safety of buyers, sellers, occupants, and licensees.
- Buyer-broker agreement. TPRE generally requests, but does not unconditionally require, that prospective buyers enter into a written buyer-broker representation agreement before being shown property. The terms, scope, duration, and compensation under such agreement are negotiable between the buyer and TPRE.
- Equal access. Application of this policy will not discriminate against any person on the basis of any class protected by the New Jersey Law Against Discrimination or federal fair housing laws. See our Fair Housing statement.
This policy may be revised from time to time. The version posted on this page is the current effective version. Any consumer who wishes to discuss exceptions or accommodations may contact us at mcompaniesos@mercerap.com.
